Types of Powers of Attorney

A Power of Attorney is a legal document that authorizes a designated person to act on your behalf; you are the “principal” giving this right to the person. The actions or decisions that your designated agent will be allowed to make in your stead will be limited to whatever your Power of Attorney says it to be. These powers may be broad, such as the power to handle all of your financial or life affairs, or limited, such as the power to sign the purchase or sale documents of a home while you are away. The name “power of Attorney” gives your agent power to make these decisions and thus makes him or her your “attorney-in-fact.”

These legal documents may be terminated in various ways, such as when the principal passes away, when it is revoked, when the designated person is no longer able to carry out the duties authorized in the document, or for some other reason. A standard Power of Attorney generally becomes ineffective should you become incapacitated. However, when created as a Durable Power of Attorney, it can remain in effect through incapacity as well. For example, a medical Power of Attorney can give your named person the ability to make medical decisions when you cannot express yourself due to illness or injury.
